These general terms and conditions of use and sale (hereinafter the “General Terms” ) are concluded between Ma petite vie and any User and/or Customer.

The Client declares that he/she is of legal age and has the capacity to enter into this agreement.

Article 1 – Definitions

“Client ” or “You” refers to the natural person placing an order on the Site or the App for private, non-commercial use.

“Content” means all photographs, images and other content uploaded by the Client to the Platform.

“Intellectual Property Rights” means all copyright, trademark, design, patent (including patent applications), whether registered or unregistered, trade secrets, manufacturing secrets or know-how, database rights, software rights or any other intellectual property or similar rights existing in the world and any claim relating to such rights as well as the right to apply for registration of such rights.

“Platform” refers to the Site.

“Site” refers to the Ma Petite Vie website accessible at www.mapetitevie.com.

“User” or “You” refers to any person using the Platform, whether or not they have created an account on it.

Article 2 – Preamble

These General Terms and Conditions govern (i) the use of the Platform by Users and (ii) the online ordering and payment for Content printing services on physical media offered by Ma petite vie on the Platform (hereinafter the “Services”). The precise characteristics of the Services are described on the Platform and are those selected by the Customer when placing their order.

Article 3 – Terms of Use

3.1. Site. In order to access the Site and benefit from the Services, you must have Internet access.

The Platform is an evolving service. Ma Petite Vie reserves the right, without prior notice or compensation, to temporarily or permanently close the Platform to perform updates, modifications or improvements, without this list being exhaustive.

Article 4 – Code of Conduct

4.1. Your commitments regarding the use of the Platform. By using the Platform you agree to (I) not use the Platform for any unlawful purpose; (II) not use the Platform in any way that could disrupt, damage, or harm Ma Petite Vie or make the Site less efficient; (III) not transfer files containing viruses, Trojan horses, or any other harmful computer programs; (IV) not access or attempt to access another User's account or circumvent or attempt to circumvent the Platform's security measures; and/or (v) not use the Platform in any way that would harm the reputation, name, or image of Ma Petite Vie.


4.2. Your commitments regarding Content uploaded to the Platform.
You are responsible for the Content you upload to the Platform and you guarantee that it:

  • does not constitute an apology for crimes against humanity, incitement to the commission of acts of terrorism, incitement to racial hatred, hatred towards persons on the grounds of their sex, sexual orientation or identity or disability, incitement to violence, in particular against women, child pornography, attacks on human dignity, threats, persecution, harassment, and in general any dangerous or illegal activity;
  • does not contain sexually explicit, obscene or shocking images or language;
  • does not infringe on individual rights (is not defamatory, slanderous, insulting or offensive) or on the privacy (in particular the right to one's image) of third parties;
  • does not violate intellectual property rights or any other property rights of third parties;
  • is not contrary to public order and morality and does not violate applicable laws and regulations.


Ma Petite Vie does not monitor the Content you upload to the Platform but reserves the right to remove such Content from the Platform and to refuse any order containing Content that is clearly illegal or contrary to the rules established above. Ma Petite Vie may also, at its sole discretion and without prior notice, deactivate your account and/or report any illegal behavior to the appropriate administrative and judicial authorities.

Article 5 – Creating an account

Your login details (account creation with email address + password) are personal to you and you will be solely responsible for the use of the Services made via your account.
You agree to (I) not disclose your login information allowing you to access the Platform to any third party; (II) immediately notify Ma Petite Vie in the event of unauthorized use of your account or any other security breach.

If your account is inactive for more than three (3) years, Ma Petite Vie may, 10 days after sending an email (I), delete all items, including the content of ordered projects (announcements and name posters).
However, Ma Petite Vie does not guarantee the preservation of Content created through the Platform or any other items stored on your account during this period. It is your responsibility to take all reasonable steps to preserve the Content, albums created, and other items stored on your account and to ensure their backup to prevent any loss.
Indeed, each creation (personalized poster, announcement, etc.) made via the platform, but not ordered, is stored on the website for only six months (this period is extended by six months if the item is in the customer's shopping cart). Ma Petite Vie may remove all elements, including the content of unfinished projects (personalized poster, announcement, etc.) stored on your account. In such cases, opening the project will extend its storage for the next six months.

Article – 6 Order

All orders are placed online on the Site.

First, you will need to select (I) the medium on which you want to print the Content, (II) a “template” or “format” from those offered by Ma Petite Vie, and (III) the Content you want to print.

You can import the Content onto the Platform via (I) your terminal.

Once you have made your selection, you will be able to review the services you have subscribed to, their price and conditions. You can modify them at any time until you accept these General Terms and Conditions.

Once the conditions of your order have been verified, you will need to (I) fill in mandatory information in the order form, such as your first name, last name, email and address, (II) choose a delivery option (with the applicable delivery charges), (III) a payment method and (IV) where applicable the promotional code (only one promotional code can be entered and applied per order).

A summary of your order will then be displayed, which you can review. You will then be asked to accept these Terms and Conditions by ticking the box provided for this purpose, and then proceed to payment.

Once payment is validated, a confirmation email will be sent to you and the order will be considered complete. The confirmation email will contain details of the services reserved, as well as the delivery cost.

Article 7 – Price of services and payment terms

5.1 Prices . Prices are quoted inclusive of all taxes (VAT) in Euros. The applicable prices are those displayed on the Platform on the date of order confirmation. Delivery charges are indicated before order validation and are billed separately.

5.2 Payment . Payment will be made directly online using a secure payment method. Available payment methods are displayed on the Platform. If you have already paid for your order and, exceptionally, we are unable to deliver it, we will refund you as soon as possible and in any case within five (5) days of receiving payment.

Article 8 – Right of withdrawal

The Customer does not have a right of withdrawal. Indeed, in accordance with Article L.221-28 of the Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of goods made to the consumer's specifications or clearly personalized.

Article – 9 Delivery

Products can be delivered to France, Europe, and Canada, depending on the delivery method you selected. If the product is delivered outside the European Union, it may be subject to customs duties and taxes levied upon arrival at its destination. These duties and taxes are your responsibility. Ma Petite Vie is not obligated to verify or inform you of applicable customs duties and taxes. You must contact the relevant authorities in the country of delivery to find out what these are.

Delivery times are indicated (I) on the product description sheet, (II) in your order summary and (III) in your order confirmation email.

You will be able to track the processing of your order via your account.

In the unlikely event that an event beyond our control (a force majeure event, as defined by the Civil Code) affects the scheduled delivery date, we will notify you of the new scheduled delivery date for your order as soon as possible. Nothing in this article affects your statutory rights to cancel the contract.

In the event that the recipient or a person who can take possession of the ordered product(s) is not present at the time of delivery, depending on the delivery method chosen, the carrier may leave a delivery notice at the indicated delivery address, inviting you to collect the product(s).

The risks associated with the ordered product are transferred to you when you, or a third party designated by you, other than our carrier, take possession of the product.

If we are unable to deliver the ordered product by the date stated in your order confirmation email, you may cancel the contract by registered letter with acknowledgment of receipt or by email, using the contact details provided in Article 11 of these General Terms and Conditions, provided that you have expressly requested us by registered letter with acknowledgment of receipt or by email to make the delivery within a reasonable timeframe, and that we have failed to deliver within the specified timeframe. The contract will be considered canceled on the date we receive your cancellation request, unless the ordered product has been delivered in the meantime.

If you have chosen a specific delivery option with a guaranteed delivery date, and if this delivery date is an essential condition for entering into the contract, and if the product is not delivered on the chosen delivery date, you have the right to cancel your contract immediately. You must inform us of your decision using the same means as indicated in the paragraph above.

In the event that your order is returned to us for any reason, it will be kept for one year from the date of receipt. After this period, if we have not received a claim from you, we reserve the right to destroy your order.

Article – 10 Returns – Commercial Guarantee

Upon delivery, please check immediately that the product(s) are complete and meet your expectations. If you are dissatisfied, please inform Ma petite vie as soon as possible by email at contact@mapetitevie.com, attaching a photograph clearly showing the problem and specifying:

  • your name
  • your order number
  • the reason for your dissatisfaction
  • your phone number.

If we decide, at our discretion, to grant this claim, we will either deliver a new copy of the product to you at our expense, or provide you with a voucher of equivalent value to the product originally ordered, to be used on the Platform.

If it is impossible to identify the problem via the photograph sent by the Customer, we reserve the right to request a return by mail of all or part of the order (the shipping costs will be reimbursed by Ma Petite Vie in the form of a voucher to be used on the Platform).

Please note that this commercial warranty is offered in addition to the legal warranties below.

Article 11 – Legal Guarantees

Legal warranty rights

Ma Petite Vie is responsible for any lack of conformity of the goods in accordance with Articles L. 217-4 et seq. of the Consumer Code as well as for any hidden defects relating to the goods in accordance with Articles 1641 et seq. of the Civil Code.

The commercial guarantee, as described in Article 10, applies without prejudice to your legal rights as described in this article.

Guarantee of conformity:

In accordance with Articles L.217-4 et seq. of the French Consumer Code, the seller must deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. The seller is also liable for any lack of conformity resulting from the packaging, assembly instructions, or installation when the latter was the seller's responsibility under the contract or was carried out under the seller's supervision.

In accordance with Article L. 217-5 of the Consumer Code, the goods conform to the contract:
1° If it is suitable for the purpose usually expected of similar goods and, where applicable:
– if it corresponds to the description given by the seller and possesses the qualities that the latter presented to the buyer in the form of a sample or model;
– if it possesses the qualities that a buyer can legitimately expect, having regard to the public statements made by the seller, the producer or their representative, particularly in advertising or labelling;
2° Or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special purpose sought by the buyer, which has been brought to the seller's attention and accepted by the latter.

In accordance with Article L. 217-12 of the Consumer Code, the action resulting from a lack of conformity is time-barred after two years from the delivery of the goods.

In the event of a lack of conformity, within 2 years of delivery of the Product, you have the right to request that Ma Petite Vie:
(a) repairs the lack of conformity of the purchased goods or replaces them free of charge, in accordance with Article L. 217-9 of the Consumer Code; or
(b) reduce the price appropriately, or terminate the contract, in accordance with Article L. 217-10 of the Consumer Code.
However, we may choose not to proceed according to your choice if that choice entails a cost that is clearly disproportionate to the other option, taking into account the value of the goods or the significance of the defect.
For the period of 24 months following delivery of the goods, you are exempt from providing proof of the existence of the lack of conformity.
Warranty against hidden defects:

You can also exercise the warranty against hidden defects as defined by Article 1641 of the Civil Code.

In accordance with Article 1641 of the Civil Code, the seller is bound by the warranty against hidden defects in the thing sold which render it unfit for the use for which it is intended, or which diminish this use to such an extent that the buyer would not have acquired it, or would have given only a lower price, if he had known of them.
In this case, you can choose between cancelling the sale or a reduction in the sale price in accordance with Article 1644 of the Civil Code.

In accordance with Article 1648, paragraph 1 of the Civil Code, the action resulting from latent defects must be brought by the purchaser within two years of the discovery of the defect.

Article 12 – Customer Service – Complaint

Article – 13 Reissue

We strive to retain your Content and orders for as long as your account is active and for three years after your last login. During this period, you will have the option to order a copy of a product that has already been delivered.
Furthermore, we retain your projects currently being printed (e.g., album projects) for six months from the date they were last opened. This storage period is extended by six months if your project is in your shopping cart.

During this period, you will have the opportunity to finalize an order that was left pending.

Ma Petite Vie offers no guarantee in the event of deletion, defects, or alterations to the storage quality of any Content uploaded by you to the Platform. Therefore, you are advised not to use the Platform as your sole means of storing your Content.

Article 14 – Intellectual Property

12.1. Intellectual Property Rights of Ma Petite Vie . The trademarks, logos, graphics, designs, album template, photographs, information, data, trade names, or service names appearing on the Platform constitute the Intellectual Property Rights of Ma Petite Vie and are its exclusive property.

These General Terms and Conditions do not grant the Client any rights to the Intellectual Property Rights of Ma Petite Vie.

Any reproduction or representation of said Intellectual Property Rights, whether in whole or in part, for any reason whatsoever and on any medium whatsoever, is subject to the prior written authorization of Ma Petite Vie. Their use in a manner inconsistent with these conditions will expose the Client to legal action by Ma Petite Vie.

12.2. Client's Intellectual Property Rights . In order to enable Ma Petite Vie to deliver the Services offered, you grant Ma Petite Vie, free of charge, the right to store and reproduce on the chosen physical medium, the Content that you have uploaded to the Platform.

Furthermore, you authorize Ma Petite Vie to use, free of charge, all or part of the Content stored on your user account for the purpose of sending personalized promotions to you, in printed or digital format, for a period of three years after your last connection to your account.

You warrant (i) that you own all rights to the Content you upload to the Platform and (ii) that you have obtained all necessary permissions to use this Content within the Platform, including to reproduce, modify and share it. Therefore, you guarantee that (i) you do not violate any intellectual property rights, privacy rights, image rights, or any other third-party rights, and (ii) you do not violate any contractual stipulation binding you or any legal or regulatory provision. In particular, if the Content contains the image of a minor (or protected adult), you guarantee that you have obtained prior authorization from the holders of parental authority or legal guardians to use and reproduce this image.

Article 15 – Personal Data

Article 16 – Responsibility

Ma Petite Vie can only be held liable in the event of fault, negligence or failure to fulfill its legal or contractual obligations which has caused you direct damage.

You are responsible for all activity that occurs on your account. Ma Petite Vie cannot be held liable (except in cases of fault or negligence) for any fraudulent use of your account caused by the loss of your login details or any other damage, of any kind, resulting from misuse or incidents related to the use of the computer or any device providing access to the Internet.

Ma Petite Vie may offer you services provided by partners via hyperlinks (including clickable advertisements, banners, buttons, etc.) placed in the various sections of the Platform. These links redirect to third-party websites, whether commercial or not. The services they provide access to, independent of Innocence's services, are offered by these partners, advertisers, or third-party service providers under their sole responsibility.

In general, Ma Petite Vie cannot be held responsible for the content, offers, information or transactions carried out on services accessible through links appearing on the Platform.

Furthermore, the Platform is normally accessible 24/7. However, Ma Petite Vie cannot be held responsible for any interruptions to the Platform and its services, whether voluntary or not.

Article 17 – Force Majeure

Ma Petite Vie cannot be held responsible in the event that the breach of their obligations under these General Terms and Conditions, or the non-delivery or delay in the performance of the Services, results from a case of force majeure, as defined in Article 1218 of the Civil Code.

Ma Petite Vie will notify the Client of any event of force majeure within eight (8) days of its occurrence. If the suspension of Ma Petite Vie's obligations is temporary, performance will simply be suspended, unless the resulting delay justifies termination of the contract. If the impediment is permanent, the contract will be automatically terminated, and the parties will be released from their obligations. Ma Petite Vie will then refund the order.

Article – 18 Insurance

Ma Petite Vie guarantees that it holds professional liability insurance with a reputable insurance company, for sufficient amounts for the provision of the Services.

Article 19 – General Provisions

19.1. Evidence. The computerized records kept in the computer systems of Ma Petite Vie will be kept under suitable and adequate security conditions and will constitute means of proof of communications, orders and payments made between the parties.

19.2. Severability. If any provision of these General Terms and Conditions is declared wholly or partially invalid or unenforceable by a court of competent jurisdiction, the remaining provisions, or parts thereof, shall not be affected and shall remain valid and enforceable (unless the invalidated provision was deemed by the court of competent jurisdiction to be an essential obligation of Ma Petite Vie). In place of the invalid or unenforceable provision, the applicable statutory provisions shall apply.

19.3. Waiver. The fact that Ma Petite Vie does not invoke one of the stipulations of these General Terms and Conditions cannot be interpreted as a waiver on its part of its right to invoke it.

19.4. Transfer. You may not transfer or assign your rights or obligations under these Terms and Conditions without the express written consent of Ma Petite Vie. Ma Petite Vie may transfer or assign these Terms and Conditions to one or more third parties without your consent, provided that such transfer or assignment does not result in a reduction of your rights as provided for in these Terms and Conditions.

19.5. Modification of the General Terms and Conditions. Ma Petite Vie may modify these General Terms and Conditions at any time. The General Terms and Conditions applicable to your order will be those in effect at the time the order is placed.

19.6. Applicable Law and Jurisdiction. These General Terms and Conditions, their interpretation, termination, or any dispute relating to their performance are governed by French law. The French courts have exclusive jurisdiction over any dispute arising from an order, the interpretation, performance, or termination of these General Terms and Conditions.

In accordance with Article 34 of the French Data Protection Act, you have the right to access, modify, rectify, and delete your personal data. You can exercise this right directly by contacting the publication director at the following email address: contact@mapetitevie.fr
